If Goods are being ordered from outside Francis & Gaye Ltd’s country of residence, import duties and taxes may be incurred once your Goods reach their destination. Francis & Gaye Ltd is not responsible for these charges and we undertake to make no calculations or estimates in this regard. 11. TERMINATION AND CANCELLATION

11.3 Francis & Gaye Ltd reserves the right to cancel purchases without stating reasons, for any reason prior to processing payment and dispatch.
11.4 If purchases are cancelled for any reason prior to dispatch you will be refunded any monies paid in relation to those purchases.
11.5 If you terminate your Account any non-dispatched purchases will be cancelled and you will be refunded any monies paid in relation to those purchases.
12. GOODS, PRICING AND AVAILABILITY

13.2 If Francis & Gaye Ltd receives no communication from you, within 10 days of delivery, regarding any problems with the Goods, you are deemed to have received the Goods in full working order and with no problems.
14. RETURNS POLICY
Francis & Gaye Ltd aims to always provide high quality Goods that are fault free and undamaged. On occasion however, goods may need to be returned. Returns are governed by these Terms and Conditions.
14.1 If you receive Goods which do not match those that you ordered, unless accompanied by an explanatory note detailing the changes, stating reasons for the changes and setting out your options, you should contact us and send back the Goods within our 30 day returns period. Francis & Gaye Ltd is responsible for paying reasonable shipment costs. You will be given the option to have the Goods replaced with those ordered (if available) or to be refunded through the payment method used by you when purchasing the Goods. Refunds and replacements will be issued upon our receipt of the returned Goods.
14.2 If any Goods you have purchased have faults when they are delivered to you, you should return the item(s) within 10 days of receipt of your order. Francis & Gaye Ltd is responsible for paying reasonable shipment costs. Goods must be returned in their original condition with all packaging and documentation. Upon receipt of the returned Goods, you will be given the option to have the Goods replaced with those ordered (if available) or to be refunded through the payment method used by you when purchasing the Goods.
14.3 If any Goods develop faults as a result of manufacturing defects within their warranty period, you are entitled to a repair or replacement under the terms of that warranty; its your responsibility to read the warranty booklet supplied by the applicable manufacturer fully.
14.4 If Goods are damaged in transit and the damage is apparent on delivery, you should sign the delivery note to the effect that the goods have been damaged. In any event, you should report such damage to Francis & Gaye Ltd as soon as possible and return the item(s) within 10 days. Francis & Gaye Ltd is responsible for paying shipment costs, you will be given the option to have the Goods replaced with those ordered (if available) or to be refunded through the payment method used by you when purchasing the Goods.
14.5 You have a statutory right to a “cooling off” period. This period begins once your order is complete and ends 30 days after the Goods have been delivered. If you change your mind about the goods within this period, please return them to Francis & Gaye Ltd within 30 days of receipt. You are responsible for paying shipment costs if Goods are returned for this reason.
14.6 If you wish to return Goods to Francis & Gaye Ltd for any of the above reasons, please contact us using the details on our Returns Page to make the appropriate arrangements.
14.7 If you placed an order using our finance facilities (V12) and or selected an optional insurance policy (March Guard) and wish to send back your goods for any reasons, you must let us know and send back the goods within 14 days from the date you placed your order otherwise Francis & Gaye will be unable to cancel your V12 purchase contract or Insurance Policy
14.8 Francis & Gaye Ltd reserves the right to exercise discretion with respect to any returns under these Terms and Conditions. Factors which may be taken into account in the exercise of this discretion include, but are not limited to:
14.8.1 Any use or enjoyment that you may have already had out of the Goods;
14.8.2 Any characteristics of the Goods which may cause them to deteriorate or expire rapidly;
14.8.3 The fact that the Goods consist of earrings and that the packaging has been opened;
14.8.4 Any discounts that may have formed part of the purchase price of the Goods to reflect any lack of quality made known to the Customer at the time of purchase.

24. WEEE REGULATIONS
As a responsible retailer Francis & Gaye Ltd abides by the WEEE Regulations as set out by the EU.
Below we have broken down this policy in to clearer terms:
The Waste Electrical and Electronic Equipment (WEEE) Directive is now UK law. The legislation aims to make producers pay for the collection, treatment and recovery of waste electrical equipment. The regulations also mean that suppliers of equipment like high street shops and internet retailers must allow consumers to return their waste equipment free of charge.
The amount of WEEE we throw away is increasing by around 5% each year, making it the fastest growing waste stream in the UK.
Recycling reduces the environmental and health risks associated with sending electrical goods like battery powered watches to landfill.
Francis & Gaye Ltd trading as Francis & Gaye Jewellers is obliged under these regulations to offer our customers free take-back of their WEEE on a like-for-like basis when they buy a new Electrical or Electronic product from us.
Customers must return their like-for-like WEEE item to us within 30 days of purchasing their new item.
Under the WEEE Regulations, all new electrical goods should now be marked with the crossed-out wheeled bin symbol which indicates the item was produced after 13th August 2005, and should be disposed of separately from normal household waste so that they can be recycled.
25. LAW AND JURISDICTION
These Terms and Conditions and the relationship between you and Francis & Gaye Ltd shall be governed by and construed in accordance with the Law of England and Wales and Francis & Gaye Ltd and you agree to submit to the exclusive jurisdiction of the Courts of England and Wales.
